Terms of use
These terms apply to the Lucernarium Ash program and its launcher (“the game”) and to the online service run by Lucernarium (“we”). By signing in to the online service you accept them. If you do not, you can still use the game offline.
What this is, and what you need
- The game is a fan-made engine and tools that run Call of Duty: World at War content from your own installed copy. You need a legitimately owned copy of the game (for example on Steam). We do not provide, contain or distribute any game files. The game reads your own files on your own computer.
- It is not made, approved or supported by Activision Publishing, Inc. or Treyarch. Call of Duty and World at War are trademarks of Activision Publishing, Inc. Other names belong to their owners.
- Mods you install are your own files, from wherever you got them. We host no mods and are not responsible for them. Do not use mods or files you do not have the right to use.
Licence to the program
The program is licensed under the Apache License, Version 2.0, as stated in the LICENSE and NOTICE files that come with it. Its third-party components and their licences are listed in THIRD_PARTY_LICENSES.md. These terms do not give you any rights to Activision’s game content, names or logos.
Your online profile
- The service creates an online profile for a gamer profile in the game. Its secret is kept on your computer, sealed to your Windows account, and the launcher’s recovery file is the only way to move or restore it. Keep that file and its passphrase private: anyone who has them can use your online profile, and we cannot recover a profile without them.
- Choose a name and clan tag that follow the rules below. We may change or remove a name or tag that breaks these terms.
- One person, one account. Do not create accounts to get around a ban, a block or a limit.
- You can delete your online profile at any time (see the Privacy notice). Online profiles unused for 90 days are deleted.
Age
You must be at least 13 to use the online service, and old enough under the law where you live to agree to these terms (or have a parent or guardian who agrees for you). The game asks you to confirm this before the first sign-in. The underlying game is rated for mature audiences (PEGI 18, ESRB M); you are responsible for deciding whether it is suitable for you.
Rules for the online service
Do not:
- Cheat: use hacks, exploits, modified clients, or tools that give you an unfair advantage over other players, or that interfere with the service or other players’ games.
- Harass others, use hateful, threatening, sexual or discriminatory language, names or clan tags, or share other people’s personal information.
- Impersonate others, the operators or staff, or Activision or Treyarch (names such as “Admin” or “Lucernarium” are reserved).
- Spam friend requests, invitations, chat or reports, or try to get around the rate limits.
- Attack, probe, overload or reverse-engineer the service beyond what the law allows, or try to access other accounts.
- Use the service for anything illegal, or to distribute game files or other people’s copyrighted material.
You can block a player and report them from the game. Use reports honestly. To report a name or content that infringes your rights, report it in the game or write to keeper@lucernarium.dev.
Enforcement
We may warn you, change a name, remove you from a party, suspend or permanently ban an account, installation or network address, delete reports or content, or stop a feature, at our discretion, to keep the service safe. We may do this without notice for serious or repeated breaches. A ban is kept on record even if you delete your online profile (see the Privacy notice).
To ask about a ban, write to keeper@lucernarium.dev or ask in #support on our Discord, with your name and tag.
Direct connections between players
The game connects players to each other directly, which shows your IP address to the players in your session. You accept that risk when you play online with others; use the relay option, a VPN, or do not play online if you are not comfortable with it. We are not responsible for what other players do.
The service is provided as is
The service and the program are free and provided “as is”, without warranties of any kind, to the extent the law allows. We do not promise that the service will be available, uninterrupted, secure or free of errors, and we may change, limit or discontinue it at any time (for example when the game’s builds change, or if we can no longer run it).
Liability
To the extent the law allows, we are not liable for indirect or consequential loss, lost data, or loss arising from other players’ conduct, from third-party software or mods, or from your use of the game with files you do not own. Nothing in these terms limits liability that cannot be limited by law (for example for death or personal injury caused by negligence, or for fraud).
Changes
We may update these terms and the Privacy notice. If a change is material, we raise the version and the game asks you to accept again before signing in. If you do not accept, you can keep using the game offline.
